This book collects in a single volume the principal California and Uniform statutes germane to courses on wills, trusts, decedents’ estates, future interests, and fiduciary administration. The California statutes are drawn mainly from the California Probate Code, but some are drawn from other California codes, such as the Family Code and the Civil Code. The Uniform statutes are drawn mainly from the Uniform Probate Code (UPC) and the Uniform Trust Code (UTC). For added perspective, a few provisions from the new Restatement (Third) of Property: Wills and Other Donative Transfers (1999 & 2003) and the Restatement (Third) of Trusts (2003) are also interspersed at relevant points throughout. Several states nearby to California have enacted the UPC and have introduced the UTC for enactment, including Arizona, Colorado, New Mexico, and Utah. Hawaii is also a UPC state. By collecting both California and Uniform statutes in a single volume, the book facilitates the study of both sets of statutory provisions. The book is organized by topic corresponding to the chapter organization in the major casebooks in the field. For example, there is a topic titled Intestate Succession and one titled Execution of Wills. For ease of comparison within each topic, the California provision is followed immediately by the corresponding uniform statutory provision. To prevent confusion, the uniform statutory provision is set forth in a bordered format.
